Can state be reduced to Union Territory without consultation of people: Sibal

The Supreme Court continued hearing a batch of petitions challenging the abrogation of Article 370 of the Constitution that accorded special status to the erstwhile state of Jammu and Kashmir. The petitions challenge a presidential order, revoking the special status, dated August 5, 2019. A five-judge Constitution Bench comprising Chief Justice of India (CJI) DY Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant will hear the pleas on a day-to-day basis except Mondays and Fridays. On August 3, Kapil Sibal, on behalf of the petitioners, argued that there was no constitutional procedure available which had rendered the Article infructuous. He said the provision of special status was of "permanent character" after the J&K Constituent Assembly dissolved in 1957. The court questioned Sibal's argument that Article 370 was beyond amending the powers of the Constitution because it is essentially a living document.  Follow indiatoday.in for live updates of the hearing by the Supreme Court.
